Favorable decision for telegate in reclaim actions
Munich, August 31, 2005 - The Regional Court of Cologne today ordered Deutsche Telekom in first instance in two proceedings to repay the full amount of excessive datacosts in the amount of 65,2 million Euros charged to telegate Group plus interest since the filing date in December 2004. An additional claim for interest payments since 1996 has not been granted. These judgements are final pending further legal actions.
In December 2004, the directory services provider sued the former monopolist for repayment of excessively invoiced subscriber data costs from 1996 to 2004. In a prior decision announced in November 2004, the European Court of Justice interpreted the "subscriber data provision costs" (so-called "data costs") for all member states of the European Union in a binding manner. Accordingly, the fees assessed by Deutsche Telekom in Germany had been excessive for many years when compared within Europe. About two weeks ago, the Federal Network Agency regulated the data costs for Germany. In future, the former monopolist will only be allowed to charge all directory services providers in the market 770,000 euros instead of 49 million euros for provision of subscriber data.
