First decision made on data cost legal actions
Munich, June 22, 2005 - In a landmark decision, the Higher Regional Court of Düsseldorf has decided positively in favor of telegate AG. Deutsche Telekom has to reimburse the directory services provider an amount of €4.25 million plus interest and administration and defense costs, totaling nearly €5 million. The claim is related to excessively invoiced costs for subscriber data from the period from January to September 1999.
telegate sued Deutsche Telekom for repayment of excessive data costs during the period of 1996 to 2004, amounting to €70 million in total, plus interest. The Higher Regional Court of Düsseldorf awarded telegate a first partial amount of the entire sum involved now in the second instance. Other proceedings concerning excessively invoiced data costs are currently pending at the Regional Court of Cologne. The next date in this matter has been scheduled for August 31, 2005.
