Deutsche Telekom loses again in the second of three lawsuits

Further positive ruling on data costs – Higher Regional Court implements Federal High Court’s ruling

Munich, 20th June 2007 – After the Higher Regional Court Düsseldorf has already adjudicated Deutsche Telekom AG on May 16^th 2007  in a first of total three lawsuits regarding the data cost reclamation on the payment of € 52,04 million, today telegate received a further positive judgment  in a second lawsuit: Thus Deutsche Telekom has to refund data costs in the amount of € 4,25 million plus interest during pendancy of legal action for excessively charged fees for the period January to September 1999.

The Higher Regional Court Düsseldorf reconfirmed  its judgement dated June 2005. The renewed ruling was made after the Federal High Court in Karlsruhe has rejected the initial ruling of July 2006  and passed it back for a renewed hearing. The special relevance of today’s ruling is based upon the fact, that for the first time a ruling in the pending lawsuits between telegate and Deutsche Telekom was made according  to the standards of the Higher Federal Court. The Higher Regional Court did not grant an appeal.

The Higher Regional Court has scheduled the final ruling for the third lawsuit of the data cost litigation cases for June 27^th 2007. In the lawsuit ‘datagate vs. Deutsche Telekom AG’ (court ref. No. VI-2U9/05)  telegate’s 100% subsidiary sues Deutsche Telekom for the repayment of € 30,72 million plus interest during pendancy of legal action for the period 2000 until 2004. The first instance ruled fully in favour of telegate.
