Federal Network Agency regulates data costs
Munich, 17 August 2005 - The Ruling Chamber 3 of the German Federal Network Agency announced its decision today on the payment procedure for subscriber data. The valid costs for the so-called offline provision of subscriber data were defined. In future, Deutsche Telekom will be allowed to charge all data subscribers only €770.000 annually. Previously, the former monopolist assessed €49 million for this service. For telegate this means in future cost savings of approximately €2 million annually.
In a decision pronounced in November 2004, the European Court of Justice interpreted the "subscriber data provision costs" (so-called data costs) for all member states of the European Union in a binding manner. Telegate has contested the excessive fees in Germany since 1996 and, at the end of 2004, sued Deutsche Telekom at the Regional Court of Cologne for repayment of datacosts for the years from 1996 to 2004 amounting to approximately €65 million, plus interest. The landmark decision announced today by the German Federal Network Agency does not directly influence the proceedings before the Regional Court. However from the perspective of telegate, it confirms the legal position of the company in the proceedings.
